Dan Walsh Obtains Judgement Reversal

9/5/2014

Dan Walsh successfully obtains reversal of the Bankruptcy Court’s Judgment granting discharge to debtor. On appeal, the District Court for the Eastern District of New York reversed the Bankruptcy Court’s Judgment, recognizing the “continuing concealment doctrine” as a basis for denial of the debtor’s discharge arising from a transfer of property more than 1 year prior to the debtor filing a petition in bankruptcy. The District Court’s Memorandum Decision should prove to be useful precedent for creditors seeking denial of a debtor’s discharge in bankruptcy.
